1. Acceptance of Terms

Welcome to TCG Party. By accessing or using our mobile application and services ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and TCG Party ("we," "us," or "our").

2. Eligibility

Age Requirement: You must be at least 13 years old to use TCG Party. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have your parent or guardian's permission to use the App.

Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Account Registration and Security

• You must provide accurate, current, and complete information during registration.
• You must maintain and promptly update your account information.
• You are responsible for safeguarding your password and must not share it with others.
• You must immediately notify us of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device for your personal, non-commercial entertainment purposes.

4.1 Restrictions

You may NOT:

• Modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices
• Use the App for any commercial purpose without our written consent
• Rent, lease, lend, sell, or sublicense the App
• Use automated systems (bots, scripts) to access the App

5. Virtual Items and In-App Purchases

5.1 Virtual Items

License, Not Ownership: All virtual items, including but not limited to virtual currency, card packs, premium subscriptions, and digital collectibles ("Virtual Items"), are licensed to you, not sold. You do not own Virtual Items.

No Real-World Value: Virtual Items have no monetary value and cannot be redeemed for cash, goods, or services outside the App.

Our Control: We retain the right to manage, regulate, control, modify, or eliminate Virtual Items at any time, with or without notice. We have no liability to you for exercising these rights.

5.2 Purchases and Payments

• All purchases are processed through the Apple App Store or Google Play Store.
• You agree to pay all fees and applicable taxes incurred through your account.
• Prices are subject to change without notice.
• No Refunds: All purchases of Virtual Items are final and non-refundable, except where prohibited by law or in cases of defective items.

5.3 Premium Subscriptions

• Premium subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions through your App Store or Google Play account settings.
• No refunds will be provided for unused portions of a subscription period.

6. Trading and User Interactions

6.1 Trading Rules

TCG Party facilitates connections between users for trading purposes. However:

• We are NOT a party to any agreement between users.
• You are solely responsible for your interactions and trades with other users.
• We do not guarantee the accuracy of user-provided information about their collections.
• We are not liable for failed trades, disputes, or fraudulent behavior between users.

6.2 Prohibited Trading Activities

You may NOT:

• Trade or sell Virtual Items for real-world money or anything of monetary value
• Use the App to facilitate unauthorized commercial transactions
• Engage in fraudulent trading practices or scams
• Harass, threaten, or abuse other users

7. User Conduct and Prohibited Activities

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload or transmit viruses, malware, or harmful code
• Harass, bully, threaten, or abuse other users
• Impersonate any person or entity
• Spam, advertise, or solicit other users
• Cheat, hack, exploit bugs, or use unauthorized third-party tools
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's operation
• Collect or harvest user data without consent

8. User Content

Your Responsibility: You are solely responsible for any content you create, upload, or share through the App ("User Content"), including collection data, messages, and profile information.

License to Us: By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with operating and promoting the App.

Prohibited Content: You may not submit content that is illegal, offensive, defamatory, obscene, or infringes on third-party rights.

9. Intellectual Property

Our Ownership: The App, including all content, features, functionality, software, and design, is owned by TCG Party and is protected by copyright, trademark, and other intellectual property laws.

Pokémon Trademarks: Pokémon, Pokémon TCG Pocket, and all related trademarks are the property of Nintendo, Creatures Inc., and GAME FREAK inc. TCG Party is not affiliated with, endorsed by, or sponsored by these companies.

Third-Party Content: Card images and data are used for informational purposes only and remain the property of their respective owners.

10. Termination and Suspension

Our Right to Terminate: We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, with or without notice, for any reason, including violation of these Terms.

Your Right to Cancel: You may delete your account at any time through the App settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

Effect of Termination: Upon termination, your license to use the App ends immediately. You will lose access to your account, Virtual Items, and all associated data.

11. Disclaimers and Warranties

AS IS Service: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• Results obtained from the App will be accurate or reliable

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TCG PARTY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless TCG Party, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

14. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

Arbitration: Any dispute arising from these Terms or the App shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization], except where prohibited by law.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TCG Party regarding the App and supersede all prior agreements.
